The following Privacy Policy (hereinafter “Privacy Policy”) explains how SparkDEX Inc. (hereinafter referred to as “SparkDEX”) collects and uses any information users (hereinafter referred to as“User”, “You”, “Your”) submit when using the Site, as defined within the SparkDEX Terms and Conditions “Terms”), available at the following link: https://sparkdex.ai/terms. This Privacy Policy should be read in conjunction with the User Terms, in which it is integrated. 


All capitalized proper nouns not defined in this Privacy Policy meet the same definitions and have the same meanings set out in the User Terms.

SparkDEX may collect the following information from You when You access or use the Interface:

  • Digital Wallet address, transaction history, and other associated information.

4. Analytics

SparkDEX uses Google Analytics to store and count page views and to calculate visitor, session, and campaign data, and track site usage for the Site’s analytics report.

5. Governmental Entities

SparkDEX may combine any data collected with information made available in third-party databases and public sources. SparkDEX may use such information to address claims, to respond to governmental inquiries or requests, or to investigate issues. Furthermore, such information may be shared with governmental entities including criminal, civil, and regulatory agencies. 


Please, be aware that SparkDEX may keep copies of Your information subject to our internal retention policies for the purposes of abiding by applicable laws or to prevent fraud or injury to a third-party.

10. Rights of the Data Subject

Right to withdraw consent 

You have the right to at any time withdraw Your consent for processing, upon which we will stop processing Your personal data based on this legal basis unless a different legal basis is applicable. The withdrawal does not affect the lawfulness of processing Your personal data based on legitimate interests before Your withdrawal.

Right of access 

You have the right to obtain access to the personal information collected about You, as well as its sources, purpose, and sharing.

11. Security Measures

SparkDEX makes reasonable attempts to protect Your data by using physical and electronic safeguards, such as encryption. However, as the Interface relies on Blockchain Technology and electronic infrastructure on which SparkDEX has no control, SparkDEX cannot guarantee the security or privacy of the information submitted. For this reason, SparkDEX recommends that You use anti-virus software, firewalls, and other precautions in order to protect Yourself from security and privacy threats.

12. Age Compliance

We do not collect or process any data concerning persons under the age of majority in Your jurisdiction (“Minors”). Please do not submit information to us if You are under the age of majority in Your applicable jurisdiction. In the event that we have inadvertently collected any data from a Minor, please contact us immediately.

13. International Transfer

Your information may be transferred to – and maintained on – computers located outside of Your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in Your jurisdiction. In addition, such information may be stored on servers located outside Your resident jurisdiction. SparkDEX is committed to managing the eventual transfer of Your personal data with integrity and according to the applicable legislation and practices that are most protective of Your rights.

14. Merger and Acquisition

In the event that SparkDEX is involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, Your data may be transferred as part of that transaction. Please, be aware that once the data is transferred Your privacy rights may be subject to change.

15. Amendments and Policy Review

As provided under the User Terms, SparkDEX may amend this Privacy Policy from time to time. 


When SparkDEX amends this Privacy Policy, it may contact You. 


If SparkDEX makes any material changes to this Privacy Policy, it will notify You by posting the updated Privacy Policy on the Site and updating the effective date at the beginning of the Privacy Policy. In order to continue to use our Interface, You must agree to the amendments. If You do not agree, You must immediately cease using our Interface.
